K1, K3, Visa Requirements and
Laws for Philippine Applicants

SPECIAL CIRCUMSTANCES
MARRIAGE IN THE PHILIPPINES

Any foreigner who wishes to marry in the Philippines is required by the Philippine Government to obtain from his/her Embassy a “Certificate of Legal Capacity to Contract Marriage” before filing an application for a marriage license.

The Government also accepts an “Affidavit in lieu of a Certificate of Legal Capacity to Contract Marriage.” The U.S. citizen must,

execute this affidavit at the American Embassy in Manila on Tuesday or Thursday mornings, or at the Consular Agency in Cebu.

The American must present his/her U.S. passport, and there is a fee of U.S. $30.00 for executing the affidavit. Philippine authorities will not accept any substitute document initiated in the United States.

THE MARRIAGE APPLICATION PROCESS
Once an American citizen has obtained from the Embassy an “Affidavit in Lieu of a Certificate of Legal Capacity to Contract Marriage,” he/she can file an application for a marriage license at the office of the Philippine Civil Registrar in the town or city where one of the parties is a resident.

The U.S. Citizen applicant will need to present: (A) the affidavit, (B) divorce decrees or death certificate(s) required to verify civil status and legal capacity to contract marriage, (C) U.S. passport, and (D) documentation regarding parental consent or advice, if applicable.

(Marriage applicants aged 18 to 21 must have written parental consent. Those aged 22 to 24 must have received parental advice.)

Who Should Use the K3 Visa?

If you are already married to, or about to marry, someone from another country, this is likely the visa for you.

This is true in most cases even when you have already filed the I-130 petition for your spouse. Obtaining a K3 visa for your international wife can reduce the time it takes to get her into the US by more than a year.

Basically, K3 visas works much like K1 Fiancee visas with a few different twists and turns. With the obvious exception that you must be married rather than engaged to the beneficiary, the requirements for the K3 visas are very similar to the K1 Fiancee visas (See K1 Visa Requirements).
The amount of paperwork involved in filing K3 visas is almost double the amount required for a Fiancée visas. While the rules in this area of immigration law have changed, there are no new visa forms or instructions available to the public that address these changes.

K3 Visa Requirements

1.The alien must be married to a U.S. citizen who has filed an I-130 petition for an immigrant visa on behalf of the alien.

2.The U.S. citizen petitioner must also file a second petition, the I-129F, with USCIS for a non-immigrant visa (K3) on behalf of the alien spouse.

The I-129F must be filed in the United States. This second petition must be approved by USCIS before the alien can begin K3 visa processing overseas.

The K3 visa must be issued in the country where the marriage took place, if the marriage occurred outside of the United States.

3.The alien must be seeking to enter the United States to await “the availability of an immigrant visa.” While visa numbers are of course not limited for spouses of U.S. citizens, the USCIS rule requires an alien who enters the U.S. as a K3 to continue to pursue the immigration process by having an I-130 petition or an adjustment of status pending approval by USCIS.

To ensure that K3s are actively pursuing immigration, USCIS will grant only a two-year admission period when the K3 enters the United States. Similarly, work authorization will be granted in two-year increments.

K4 Visas for Unmarried Children of Foreign Spouses

The foreign spouse’s unmarried children under the age of twenty-one can be included in the parent’s petition and receive K4 visas with the same privileges as the parent’s K3 visa.

However, if a child is 18 years of age or older at the time of marriage then, although the child can receive a K4 visa and enter the U.S., that child cannot obtain a green card and become a U.S. immigrant. The child’s K4 visa will simply expire after two years or when the child reaches the age of 21, whichever occurs first.

Who Cannot Use the K3 Visa?

K3 Visas can only be obtained by the spouse of a United States citizen. Wives of permanent residents cannot receive K3 visas. Children who are married or over the age of twenty-one cannot receive the K4 visa.

If the marriage took place while the spouse was in the U.S. on another type of temprary visa or visa waiver, the spouse must depart the U.S. in order to be eligible to receive a K3 visa.

How to Prove a Bona Fide Relationship for Marriage-Based Visa

To get a green card through marriage, a couple must prove they have a bona fide relationship. Due to the high volume of illegal migrants that come to the US, officials want to make sure that marriage visas are issued only to people who have genuine ties with those who file a petition on their behalf. In other words, the petitioner and beneficiary must prove that they’re not faking a relationship just so the latter could get a US visa

There are several types of marriage visas. A K-1 Visa is a non-immigrant visa issued to a fiance or fiancee of a US citizen so that they may enter and get married on US soil. A CR-1 or IR-1 Visa is an immigrant visa which grants legal permanent residence (the green card) to the holder when he or she enters the country. A K-3 Visa is another non-immigrant visa that lets the spouse enter the US while awaiting their immigrant visa.

Start as soon as possible.

Many couples think of gathering evidence for a marriage visa only when it’s time to file the petition. This is a mistake. You want to document your relationship from the start.

Use various methods of communication.

Don’t limit youselves to just e-mail and chat. These are weak evidences since they are free. Send each other postcards, greeting cards and snail mail. Make overseas calls or, if that’s too expensive, send text messages.

Obtain printouts of your correspondences.

When printing e-mails and chat records, try to print from within the original environment as much as possible. This preserves the formatting. Include URLs, date stamps and page titles. When printing web mail, you can configure your browser to include this info in the header and footer.

Most web-based e-mail have an option like “Print” or “Print-friendly.” Click on them to get a printer-friendly version of the e-mails you want to print.

Obtain phone records.

You can get phone bill records if you have a postpaid phone account. Check your account online- you may be able to prin them from there. If so, print your records regularly since your provider may delete old records after some time. Otherwise contact their customer support and ask how you can get phone records.

Take your time getting to know each other.

Don’t be in a hurry to file a marriage visa petition. When a couple applies for a visa after knowing each other for just a few months, it casts doubt over their relationship. So take the time to get acquainted with each other. Spend as much time as possible together. The older your friendship or courtship, the more convincing you appear.

Save receipts, passports with travel stamps, ATM withdrawal slips, boarding passes and other proofs of travel.

Documentary evidences such as these are as strong as photos, if not stronger. The dates on these must be consistent with the timeline you give in your cover letter later on. Make photocopies of these documents just in case they get lost.

Obtain proofs of financial involvement.

Money transfers and joint bank account statements are strong indications of a relationship. But don’t overdo this since neither of you wants to appear like a “sugar mommy” or “sugar daddy” of the other.

Take pictures of you together when you visit.

Pictures really do speak louder than words when it comes to fiance and marriage visas. When you visit your fiancee or spouse, bring your camera and take pictures of yourselves. Make sure you look happy and in love in them.

When you visit with his or her family, do the same. If possible, use a background or prop that suggests when the images were taken. (For example, an annual religious procession, a newspaper, etc.) Take hundreds of photos.

Make as many visits as you can afford.

The more visits you make, the less rushed you appear. It suggests you took time deciding if you would get married or not. Just saying “It was love at first sight” has been known to work (I’ve sene cases like this), but if you want to play safe, wait a bit longer. Save money and make more trips to your partner’s country.

Get married and live together if possible.

Nothing can prove a bona fide relationship more than living together, paying bills together and maybe even having children. While it’s not possible for many, it sure would help if you could do it. Proofs of cohabiting would include bills and letters – some in the petitioner’s name, others in the beneficiary’s name – showing you share the same address. If possible, get both your names on the lease contract.

MAKING YOUR RELATIONSHIP KNOWN.

Meet each other’s relatives, or at least be acquainted with them.

When your families know about your relationship, it makes it look genuine. Meeting in person is ideal. But if this isn’t possible, make phone calls, chat, send e-mail and holiday cards. No need to send gifts as that can be misinterpreted.

Make your presence felt among friends, neighbors, etc.

Introduce yourselves to each other’s friends. If needed, they can make sworn affidavits stating they know of your relationship. In the absence of friends, get acquainted with neighbors, hotel staff (if you go on a honeymoon or vacation) and even hospital staff.

ORGANIZING AND PRESENTING YOUR EVIDENCES.

Gather your evidences according to strength and importance.

Now it’s time to organize the proofs of your relationship. You aren’t going to use all of your documentation. Instead you will pick the best of them to bring to the interview at the US Embassy.

The most important types of evidence are: photos, travel records, joint bank statements, marriage certificate, birth certificates of children born to you and proof of living together. Next are phone records, gifts, cards, receipts and letters from friends and family. Last are e-mail and chats.

Organize your evidences.

Get a document bag or folder. File your proofs neatly in it. The beneficiary must bring this to the interview along with his or her medical report and appointment letter.

Your documents must be so arranged that the beneficiary can quickly retrieve whatever the consul (interviewing officer) will ask for.

Present your evidences.

During the interview at the US embassy, the beneficiary will sign form DS-230 part 2; his or her fingerprints and picture will also be taken. The consul will go over the proofs of relationship while asking questions.

It helps if the beneficiary stays calm and focused. Answer simply. Be ready to answer questions about the proofs, such as “When was this picture taken? Who took it?” and so on.

Finish the interview.

If all goes well, the beneficiary will be granted a US visa. Sometimes though, the consul may ask for more evidence. Pay attention to his or her instructions.

Bring what’s required for a second interview. If you find you cannot overcome the issues raised by the consul, you may want to hire an immigration lawyer.

Philippines Permanent Resident Visa 13 (a)

First of all, a 13 (a) Visa and a 13A visa are the same. The 13(a) and 13 A designation are sometimes used interchangeably.

Why is this Visa called a 13A Visa? It is called a 13A Visa because the 13A refers to the Philippine Immigration Act of 1940, Section 13 (a). It is a Visa issued to an alien on the basis of a valid marriage to a Philippine citizen.

Qualifications:

To qualify the alien must meet the follow criteria:

• Have a valid marriage with a Philippine citizen.

• The marriage must be recognized as valid under existing Philippine laws.

• There is no record of any derogatory information against the alien in any local or foreign law enforcement agency.

• The alien must not be afflicted with any dangerous, contagious or loathsome disease.

• The alien must have sufficient financial capacity to support a family and will not become a public burden.

• The alien must have entered the Philippines legally and has been authorized by Immigration authorities to stay in the Philippines.

• A 13 A Visa is available to citizens of a country which grants permanent residence and immigration privileges to Philippine citizens.

How Do You Apply for a 13 (a) Visa?

Request an application form (Form number RBR 98-01) from the Public Assistance Unit of the Office of the Commissioner. Complete and return the form. If you will be accompanied by your unmarried minor children they must fill out a separate form as well.

All documents to support your application must be properly certified as true copy. Sworn statements or affidavits need to be notarized.

Foreign documents must be duly authenticated by the Philippine Embassy or Consulate at the place where they have been issued. Submit the application form with the supporting documents to The Bureau of Immigration. You must pay the filling fee.

NOTE: Filing fee should first be paid before an application is filed.

Filing Papers for Permanent Resident Visa, 13A – What to Expect The paperwork involved in applying for the 13(a) visa here is not particularly difficult. However, there is a lot of time involved and visits to various departments.

You will need to prove that you are really living as man and wife. You will need health clearance which may involve X-rays. You will also need to prove your financial situation with various notarized affidavits.

The various notaries that are just outside the Bureau of Immigration will have all the required affidavits available and will type them up for you and notarize them. The costs involved in notarizing are around P50 per sheet of paper, so a few hundred pesos will be sufficient to cover the paperwork and the notarizations.

After you submit all the paperwork you will have to wait for several weeks until you receive a notification to attend an interview with your spouse. Your spouse will be questioned mainly to determine whether he/she really wants you to be a resident.

Upon the successful passing of this interview your will then have to wait several weeks until the visa is granted after your application is approved by the Board of Commissioners.

This first application process will grant you a probationary 13(a) visa for one year. You will then have to submit another, simplified, application one year after the date of the initial 13(a) Visa. The fees are not high but the process can be tiresome. Please exercise some patience.
